In the end, the judge found that it was not the coercive text messages that caused Roy's death. At one point, he told Carter that he was scared, but she told him to get back inside. Carter, now 20, is to be sentenced Aug 3 and faces up to 20 years in prison. A sentencing hearing is scheduled for August 3.

According to Cataldo, among Carter's many messages with Roy, she told him to seek "professional help". Carter continued, "But I bet you're gonna be like "oh, it didn't work because I didn't tape the tube right or something like that"..."

But Moniz said when Roy got out of the truck, it proved he wanted to live.

The ACLU in MA has called Conrad Roy's death a tragedy, yet say that there is no law in the state that makes it a crime to try and persuade someone to kill themselves, as Mass Live report.

"This is saying that what she did is killing him, that her words literally killed him, that the murder weapon here was her words", said Matthew Segal, a lawyer with the American Civil Liberties Union of MA, which raised concerns about the case to the state's highest court.

Matthew Segal, legal director for the American Civil Liberties Union of MA, said he thinks the judge's ruling could have a chilling effect on free speech, particularly when it comes to end-of-life discussions with terminally ill people.

The case has set a legal precedent as there is no law in MA which makes telling a person to commit suicide a crime.
