Relief in India as UN court orders Pak not to execute Jadhav

19 May 2017, 10:04 | Todd Saunders

Meanwhile, Pakistan adviser on foreign affairs, Sartaj Aziz said Islamabad would decide about the consular access to Jadhav in the light of "national security dynamics". "Pakistan's contention before the International Court of Justice that this case was taken to the military tribunal because there was issue of terrorism, this is a lie", Sharma said.

Former Pakistan attorney, General Irfan Qadir told Dawn that the country's lawyers, who argued the case at ICJ, were "inexperienced".

The International Court of Justice unanimously ruled Thursday that Kulbhushan Jadhav should not be executed pending the outcome of a suit filed by India that alleges Pakistan violated Jadhav's right to consular and attorney access after his arrest past year.

The ICJ on Thursday ordered Pakistan to halt the execution of Indian spy Kulbhushan Jadhav until a final decision in the proceedings.

"Urging the United Nations and the the worldwide community to understand the double game of Pakistan, Mengal said", Pakistan is a hub of terrorism as it is producing Islamic terrorism for the entire world.

India said Thursday, there was no ambiguity in ICJ's judgment, which it said created a legally binding worldwide obligation on Pakistan. The ICJ also said that its ruling is binding.

It also noted the urgency of the case since Pakistan had given "no assurance that Mr Jadhav will not be executed before the court has rendered its final decision".

Shehu said the government was working to verify the identities of the 82 released so they can be reunited with their families as soon as possible.

The International Court of Justice granted these measures after a public hearing was conducted on May 15. He added that the ICJ verdict had shown that the military court trial by Pakistan was a "charade", and that the neighbour had been completely "blown away" by it.

People distributed candies and, burst crackers at Jadhav's Powai residence and hoped that the former Indian Naval officer returns to India safely.

Deadline for Indian spy Kulbhushan Jadhav to appeal against his death sentence ends today (Friday), Samaa reported.

Earlier, the ICJ stayed the execution and upheld India's right to have consular access to the former naval officer.

He said Pakistan's position was clear as it was a matter of national security.

"The decision to stay Jadhav's execution pending ICJ hearing is unanimous", said ICJ President Ronny Abraham. She also said that the union government is grateful to Harish Salve for presenting India's case so effectively before ICJ.
